As a condition of selling items in a Just Between Friends Consignment Sale, I represent, warrant and agree that the following are true and correct in all respects:
I, understand and agree that Just Between Friends (JBF) Columbia and Just Between Friends Franchise Systems, Inc. are not responsible for fire, loss, theft or damage to the items I am consigning. I am being allowed to place my items on JBF’s sales floor for my benefit and at my request and at no charge to me except entering this agreement up to the moment of sale.
I understand that I will earn 60% of my gross sales, less a Consignor Fee ($10, $15, or $20, depending on date of payment) (unless said consignor fee has been waived or discounted pursuant to other offers; if consignor fee was not paid in advance, it will be deducted at the maximum rate of $20) for participation in the JBF sale. I understand that Consignors who work at the sale for a minimum of 4 hours during the sale with JBF will be compensated separately for said arrangement (or 12 hours for those consignors with more than 500 items, including one shift at sort or breakdown).
Pick up is MONDAY, April 28, 2025 from 11:00am-1:00pm. I understand that every item not picked up before 1:00 pm will be donated. NO EXCEPTIONS.
I also understand that JBF Columbia is only a broker or agent for the Consignor. JBF Columbia has no obligation to pay for unsold items. Title possession remains with the Seller.
I understand that I will receive an echeck to the email registered on myjbftags.com, within 2 weeks of the sale ending, in the amount of the percentage of sales identified above. If I report unsold items, I may receive my check after said two week window.
I understand that there is a 90-day window to retrieve and deposit my check. After that time, a $35 charge will apply to place a stop on the original payment and reissue.
I understand that I may incur additional fees of $1.00/battery if any battery-operated items I am selling require a battery replacement during the sale in order to show that the item is in working order.
I understand JBF Columbia will sell the items I am consigning for the price listed on the barcode tags I have created. I understand that the price sold will be controlled by the printed tag attached to the item & NOT any subsequent changes online.
I understand if my item is marked full price (with a star on the tag), it will only be sold at full price; if my item is marked to reduce (without a star), it will be sold at 50% off during scheduled discount hours. If there is a “D” on the tag, I acknowledge that said item will be offered for sale at 75% off the tag price during the last hour of the sale (2-3 pm, Sunday, April 27) and is to be donated at the end of the sale if remaining unsold. I verify that I have no hand-written information on any tags.
I am the owner of, have full authority to sell, and have carefully inspected the items that I am consigning/selling.
Each item is clean and sanitized, in good operating condition & is not defective, broken or damaged in any way and has no missing pieces. Any repaired item was repaired by the original manufacturer or in accordance with the original manufacturer’s warranty program.
I understand that by appearing in a public venue as a shopper or consignor, JBF has my permission to use my image in any JBF publicity avenue they choose, & I agree that no royalty or other payment is due me because of the use of any such image.
Each item I am consigning complies with applicable law. No item is the subject of any pending or threatened recall notice or other consumer protection enforcement action. Or if any of my items were part of a recall, any repair made is by the original manufacturer or made in accordance with the original manufacture warranty program. If a refund is made to a shopper due to a product not working, missing parts or a defect, I understand that I, the consignor will not be paid for this item. It is recognized that “all sales are final”, however, it is illegal on the consignor’s behalf to offer for sell a recalled item and it against JBF's policies to offer for sale items with missing or broken pieces, and good customer service is a priority with JBF. I know of no reason why any item offered for sale by me would cause any injury to another.
By registering to participate, I confirm that: (1) I have read & fully understand this Consignor Agreement & Liability Waiver, including the Representations & Warranties stated above;
By registering for my drop off pass, I confirm that: (2) I agree to and warrant as stated above; & (3) no one has made to me representations, statements, or inducements that change or modify anything written in this Consignor Agreement & Liability Waiver.
